According to Africanews, the Randburg Magistrates' Court in South Africa has denied bail to Shadrack Sibia, a former deputy commissioner of the national police force. The court found that he had failed to show why exceptional circumstances warranted his continued detention and accepted the prosecution's argument that his release could pose a danger to witnesses. Prosecutors are also concerned that he may flee South Africa and said they would oppose any appeal against the ruling.

The 59-year-old Sibia faces charges including the rape of an 18-year-old girl, human trafficking and sexual grooming of a 16-year-old girl. He denies all the allegations and says the sexual contact with the 18-year-old woman was consensual. According to the prosecution's allegations, he gave the woman alcohol at a hotel in Johannesburg and then raped her after she lost consciousness. Sibia was arrested in September and resigned from the police force the following month.

Prosecution spokesperson Kaiser Ganing said outside court that the prosecution had submitted all the facts in its possession to the magistrate and that it was prepared to oppose an appeal. "Justice must be fully realised," he said. The magistrate also said there was evidence indicating that Sibia might stop at nothing to conceal evidence adverse to him.

Africanews also reported that Sibia is undergoing a Judicial Commission investigation chaired by a retired judge. Its scope includes allegations of corruption within the police force and his connections with members of a suspected criminal network. According to allegations heard by the commission, he had close relationships with those involved and had received substantial amounts of cash and gifts. These claims remain allegations in the investigation, and the report did not indicate that the commission had reached any final findings.

As Sibia once sat within the national police force's leadership, the case concerns not only his personal criminal liability but also whether senior police officers can be subjected to the same judicial scrutiny as other accused persons during bail proceedings and subsequent trial. The Randburg court's refusal to grant bail blocks immediate release but does not determine whether the criminal charges are proven; the investigations into alleged internal police corruption and Sibia's links to a suspected criminal network also remain under way.
