Trump White House's media ban blocked by court; accused of using "fake news" and "national security" to evade questions

CNN, MS NOW and Politico have sued the Trump administration in federal court, alleging it violated their constitutional rights by restricting White House press access. A federal court issued a temporary injunction last month, but according to NPR, the White House's compliance has been inconsistent, and it has cited "fake news" and "national security" to deflect media questions about the area beneath the newly built East Wing ballroom and the White House bunker.

According to an NPR report dated October 8, CNN, MS NOW and Politico appeared in federal court that day, arguing that the Trump administration had violated their constitutional rights by restricting their White House press access. This is the latest round of judicial confrontation in the White House's ongoing standoff with mainstream media.

Last month, a federal judge issued a temporary injunction barring the Trump administration from excluding the three media organizations from the White House during the case's proceedings. However, according to NPR reporter David Folkenflik, the White House's compliance with this order has been inconsistent — CNN has been barred from carrying out its regular reporting work in small spaces such as Air Force One.

The White House's position is that these media outlets "spread fake news" and has invoked national security concerns in response to its reluctance to answer questions about the White House bunker and the area beneath the newly built East Wing ballroom. Questions about a ballroom renovation and an underground space are far removed from what is ordinarily understood as national security concerns; and the "fake news" accusation itself is aimed squarely at the content of the reporting.

The lawsuit's true focus is the boundary of a legal standard: the White House has the right to decide whether to issue credentials for access to its premises to specific organizations, but once press credentials are granted, they cannot be revoked because of dissatisfaction with related reporting. The line between access decisions and content judgment is at the heart of the dispute.

The ultimate legal direction of the case remains uncertain, and the boundary between the White House's authority to manage its physical premises and the constitutional protection of press freedom will be further clarified in subsequent proceedings.
